Justice Secretary Vitaliano Aguirre II on Sunday said President Rodrigo Duterte can only suspend the writ of habeas corpus if there is actual “rebellion or invasion.”
“Hindi ka naman basta-basta makakadeklara ng suspension of writ of habeas corpus kung dahil sa lawlessness lang. Kailangan may rebellion o invasion. Hindi mo naman masasabi na may invasion, walang invasion of course sa Muslim Mindanao,” Aguirre said in a radio dzBB interview.
[You cannot declare a suspension of writ of habeas corpus out of lawlessness alone. There has to be a rebellion or invasion. You cannot see an invasion, of course in Muslim Mindanao.]
